2. Categories of Personal Data Processed
2.1 – When you fill out the contact forms on our website or contact us via email, telephone, fax, social networks, Landing Page or Newsletters, Modima collects:
the basic identity information you provide, such as name, email address, address, telephone number;
the content of your communication and the technical details of the communication itself (date and time, etc.);
preferences regarding the receipt of email communications, such as newsletters, announcements, etc.;
electronic identification data, such as IP address;
publicly available information on your Social Media profile and any other personal data you provide to us.
2.2 – Whenever you give us your business card or interact with us at trade fairs and events in which we participate, we may collect:
the basic identity information you provide, such as name, email address, postal address, telephone number, the company you work for and your position (i.e., when such information is provided or displayed on your business card).
3. Purposes of Processing Your Data
3.1 – Modima processes your personal data in order to provide, in a personalised and efficient manner, the information, products and/or services requested via the website, email, telephone, fax, social networks and trade fairs or events.
3.2 – Modima processes your personal data to communicate with you following our contact at a fair and/or event or as a result of your approach via the Website, email, telephone, fax or Social Networks.
3.3 – Modima processes your personal data to conduct statistical analyses so that we may improve our website, products and services or develop new products and services.
3.4 – Modima processes your personal data to comply with legal obligations or to respond to any reasonable request from competent law enforcement authorities, judicial authorities, agencies or governmental bodies, including competent data protection authorities. Your personal data may be transferred at Modima’s initiative to the police or judicial authorities as evidence or if there are justified suspicions of an unlawful act or crime committed by you through your registration or use of our Website, Social Networks or other communication with us.
3.5 – Modima may process your personal data to inform any third party in the context of a possible merger, acquisition by/or decision of that third party, even if such third party is located outside the EU.
3.6 – Modima may process your personal data to preserve the legitimate interests of Modima – Maria Nunes & Soares Ferreira, its partners or third parties, if and when your registration or use of the Website, Social Networks or other communication channels may be considered (a) a violation of applicable terms of use or intellectual property rights or any other rights of third parties, (b) a threat to the security or integrity of the website, (c) a danger to the website or any underlying systems of Modima or its subcontractors due to viruses, Trojan horses, spyware, malware or any other form of malicious code, or (d) in any way hateful, obscene, discriminatory, racist, defamatory, malicious or otherwise inappropriate or illegal.
3.7 – Modima processes your personal data mentioned in clauses 2.1 and 2.2 above for marketing purposes, i.e., to provide targeted communications, promotions, offers and other announcements from Modima and selected partners. Modima will only send communications, promotions, offers, newsletters and other announcements via email or other electronic person-to-person communication channels if you have explicitly consented to receiving such communications.
4. Lawfulness of Processing Your Data
4.1 – For processing your personal data for the purpose described in clause 3.1, we request your consent.
4.2 – Processing your personal data for the purpose outlined in clause 3.4 is necessary to allow Modima to comply with its legal obligations.
4.3 – Processing your personal data for the purposes described in clauses 3.2, 3.3, 3.6 and 3.7 is necessary for the legitimate interests of Modima, which are:
being able to adequately respond to your requests for information and other requests;
sharing your personal data with our partners to provide appropriate information;
allowing us to defend ourselves in legal proceedings;
continuous improvements to the website, social media channels, products and services to ensure that you have the best possible experience;
keeping our website, social networks and products and services protected against misuse and illegal activities;

4.4 – For processing your personal data for the purposes described in clause 3.1, Modima, as the controller, requests your consent. By consenting to the processing of your personal data for the sending of communications, promotions, offers, newsletters and other announcements via email or other electronic person-to-person communication channels, you agree that we are authorised to process your personal data for this purpose in the manner and under the conditions described in this Privacy Policy.
5. Data Processing Legitimacy
5.1 – Modima – Maria Nunes & Soares Ferreira makes every effort to process only the personal data necessary to achieve the purposes listed under the processing purpose.
5.2 – Your personal data is processed only for as long as necessary for the purposes listed above or until you withdraw your consent. Modima will stop identifying your personal data when it no longer serves the purposes described, unless there is:
an overriding interest of Modima or any other third party in maintaining your personal data identifiable;
a legal or regulatory obligation or a judicial or administrative order preventing Modima from anonymising it.
5.3 – Modima will take appropriate technical and organisational measures to keep your personal data safe from unauthorised access or theft, as well as accidental loss, tampering or destruction. Access by Modima’s staff or third parties will be strictly on a need-to-know basis and subject to confidentiality obligations. However, confidentiality and security are best-effort obligations and can never be guaranteed.
6. Data Subject Rights
6.1 – You have the right to request access to all personal data processed by Modima that pertains to you. Modima reserves the right to charge an administrative fee for multiple subsequent access requests that are clearly submitted to cause inconvenience or harm to Modima.
6.2 – You have the right to request that any inaccurate personal data be corrected free of charge. If a rectification request is made, it must be accompanied by proof of the inaccurate nature of the data for which correction is sought.
6.3 – You have the right to withdraw your previous consent, as per clause 4.4, for the processing of your personal data.
6.4 – You have the right to request that your personal data be erased if it is no longer necessary in light of the purposes described above or if you withdraw your consent to its processing. However, it is necessary to bear in mind that a deletion request will be evaluated by Modima with regard to:
overriding interests of Modima or any other third party;
legal or regulatory obligations or administrative or judicial orders that may contradict such deletion.
Instead of deletion, you may also request that Modima restrict the processing of your personal data if and when: (a) you contest the accuracy of such data, (b) the processing is unlawful, or (c) the data is no longer necessary for the purpose described above, but you may need it to defend yourself in legal proceedings.
6.5 – You have the right to object to the processing of your personal data if you can prove that there are serious and justified reasons related to your particular circumstances that justify such objection. However, if the intended processing qualifies as direct marketing, the data subject has the right to object to such processing free of charge and without justification.
6.6 – You have the right to receive, in a structured, commonly used and machine-readable format, all personal data you have provided to Modima – Maria Nunes & Soares Ferreira.
6.7 – If you wish to submit a request to exercise one or more of the rights listed above, you may send an email to geral@modima.pt regarding all matters concerning data subject rights. An email requesting the exercise of a right should not be interpreted as consent to the processing of your personal data beyond what is necessary to handle your request. The request must clearly specify which right you wish to exercise and the reasons for it, if necessary. It must also be dated and signed, and accompanied by a scanned copy of your valid identification card to verify your identity.
Modima will promptly inform you of the receipt of such request. If the request is valid, Modima shall notify you within a reasonable timeframe.
